§ 12-68. Administration.

  • (a)

    The City Council of South Houston, Texas, hereby designates and directs the Chief of Police of the City of South Houston, Texas, or his/her duly authorized representative(s) ("executive director") to accept applications for a sexually oriented business permit and to certify compliance with the location requirements. The City of South Houston also directs the Chief of Police of the City of South Houston to investigate, deny, issue, attach conditions to, and to suspend and revoke sexually oriented business permits (SOBPs) pursuant to the above authority and these regulations.

    (b)

    The executive director may enforce these regulations. An appeal shall not automatically stay the effect of the executive director's determination. The chief of police and the South Houston Police Department are authorized to investigate sexually oriented businesses' service records and to investigate and enforce the provisions of this ordinance as set forth herein.

    Pursuant to Section 243.007(c) of the Local Government Code, the District Court has jurisdiction over a suit that arises from the denial, suspension or revocation of an SOBP by the county.

    Sections 243.010(a) and (b) of the Local Government Code, as amended, authorize the State of Texas to prosecute a violation of these regulations as a class A misdemeanor.

    The revocation or suspension of an SOBP shall not prohibit the imposition of a criminal penalty and the imposition of a criminal penalty shall not prevent the revocation or suspension of an SOBP pursuant to these regulations.
