§ 16.5-57. Warrant execution by arrest.

  • (a)

    Participants are encouraged to use alternative means to execute their issued warrants prior to incarcerating warrant suspects when practical, however, when affecting such arrest, commissioned members shall adhere to relevant laws and department policies.

    (b)

    Participants shall be further governed by the following guidelines concerning all warrants that are executed by arrest:

    (1)

    They will be executed only by a uniformed commission member of South Houston Police Department.

    (2)

    The commissioned member thus executing a warrant must be in a marked South Houston Police Department vehicle. The use of this vehicle must be approved by the chief of police or his/her designee; all commissioned members using this vehicle must be in uniform.

    (3)

    When executed inside the corporate limits of South Houston by one (1) South Houston Police Department commissioned member.

    (4)

    When executed outside the corporate limits of South Houston by one (1) South Houston Department commissioned member, he/she shall before entering another city call and request a backup from the law enforcement agency having primary jurisdiction at that location.

    (5)

    When executed outside the corporate limits of South Houston by two (2) or more South Houston Police Department commissioned members, they shall notify the law enforcement agency having primary jurisdiction at that location and inform them of their intentions, but will not be required to have a member of that agency present.

    (6)

    Commissioned members shall contact the chief of police or his/her designee for instructions prior to attempting to arrest any person on a municipal warrant (except as the result of a routine traffic stop) when that person:

    a.

    Has prior felony convictions;

    b.

    Is currently a fugitive from justice; or

    c.

    Has a history of any assaultive offense.

    (7)

    Noncommissioned members shall not participate in the physical arrest of persons named in any municipal warrants.

    (8)

    Noncommissioned members are expressly prohibited from accompanying any commissioned member in a marked police vehicle while conducting any warrant service activity without explicit authorization from the chief of police. (This singular exception would be for the positive identification of a warranted subject only).
