§ 9-51. Definitions.

  • (a)

    Fire lane is defined for the purpose of this article to mean an area appurtenant to entrances or exits of an assembly building, shopping center, hospital, apartment house, hotel/motel, school, or other commercial buildings which are deemed necessary by the fire official to remain free and clear of parked vehicles and other obstructions in order to provide access to such building in case of fire or other emergency and designated by the fire official. Such land shall be of a width of not less than twenty (20) feet perpendicular to such exits and entrances and shall extend for the minimum length necessary to provide access to such building in case of fire or other emergency and designated by the fire official. It is further provided that the fire official shall not designate a lane of more than fifteen (15) feet perpendicular to exits or entrances of buildings if the designation of a lane of more than fifteen (15) feet would necessitate structural changes to existing buildings.

    (b)

    Shopping center is defined for the purpose of this article to mean a group of commercial business establishments, planned, developed, owned or managed as a unit, with off-street parking provided on the property, and related in location, size, and types of shops to the trade area that the unit serves.

    (c)

    Hospital is defined for the purposes of this article to mean any public or private hospital, convalescent home or nursing home.

    (d)

    Apartment house is any building, or portion thereof, which is designed, built, rented, leased, let or hired out to be occupied, or which is occupied as the home or residence of three (3) or more families living independently of each other and doing their own cooking in such building, and shall include flats and apartments.

    (e)

    Assembly building is a building, or portion of a building used for the gathering together of fifty (50) or more persons for such purposes as deliberation, education, instruction, worship, entertainment, amusement or awaiting transportation, or of one hundred (100) or more persons in drinking or dining establishments.

    (f)

    School is a building, public or private, used for educational purposes, and having an attendance of fifty (50) or more persons.

    (g)

    Fire official is the fire marshal.

    (h)

    Proper officer, for the purposes of this article, shall include the fire marshal, fire chief, chief of police, inspectors of the fire prevention department, and officers of the police department.

    (i)

    Fire protection device shall mean a device such as sprinkler connection, stand pipe connections, and fire hydrants, public or private.

    (j)

    Commercial building shall mean a structure which is used for the carrying on of business or trade.

    (k)

    Hotel/motel shall mean any building or buildings in which the public may, for a consideration, obtain sleeping accommodations. The term shall include hotels, motels, tourist homes, houses or courts, lodging houses, inns, rooming houses, or other buildings where rooms are furnished for a consideration but shall not include hospitals, sanitariums, or nursing homes.
